In litigation encompassing both coasts, situated primarily in U.S. District Court, District of Massachusetts; Jantzen & Associates, P.C., obtained a $1.2 million settlement in conjunction with SAP software litigation brought by a large oncology equipment manufacturer against the firm’s client, a small Massachusetts-based SAP installation company. Handling the liability defense, the counterclaim and the concomitant insurance coverages, Jantzen & Associates deftly defended the underlying case resulting in no recovery for the plaintiff and simultaneously constructed a $1.2 million settlement to be paid by the client’s own insurer to the client; pursuant to a professional liability policy. This “Bet The Farm” litigation resulted in the salvation of the small SAP Massachusetts-based provider, which still thrives to this date.

In JGMCJ Corporation v. Goodwill of Merrimack Valley, Inc. et al., 155 N.H. 452 (2007), the Supreme Court of New Hampshire, Case No. 2006-0558, Attorney Jantzen of Jantzen & Associates successfully defended the officers and directors of Goodwill of Merrimack Valley, Inc. and related entities against claims of misfeasance and malfeasance under a D&O Policy, issued by a world-wide insurer under a reservation of rights. Facing a $5 million claim, Jantzen & Associates obtained Summary Judgment in the New Hampshire Superior Court, which was later upheld by the New Hampshire Supreme Court, after oral argument. Insurers And Self-Insureds In Litigation

Our company successfully defended 36 straight breach of contract actions/93A actions brought against its insurance client in the District Courts of Lowell, Newburyport, Salem and Lynn, by interposing a unique evidentiary defense, which plaintiff counsel could not overcome in all 36 cases. Several of the cases were appealed to the Massachusetts Appellate Division, where the underlying trial court justice’s decisions were upheld.

C. Insurance Law Case

In 2020 and 2021, Jantzen & Associates successfully represented Metropolitan Property and Casualty Insurance Company in the Superior Court and the Appeals Court, in the case of Holzberg v. Metropolitan Property and Casualty Insurance Company, Appeals Court, Docket No. 2020-P-0800. The Appeals Court argument was led by partner, Peter Riordan, and partner, Christopher Jantzen. Jantzen & Associates has practiced before the Massachusetts Appellate Division, Massachusetts Appeals Court, and the Supreme Judicial Court on behalf of numerous business clients and individual clients for over 17 years. D. Personal Injury and Worker’s Compensation

1. Jantzen & Associates obtained one of the largest 2019 Worker’s Compensation settlement in Massachusetts, garnering $500,000 for a Brazilian immigrant painter, who fell 17 feet off the roof suffering a brain injury. The lump-sum settlement of $500,000 was near the insurer’s total exposure. Now the firm pursues the third-party action against the non-employers in 2021. That case is pending in Superior Court.

2. In 2020, the firm forced through a $140,000 Worker’s Compensation settlement for a Brazilian immigrant painter who fell from a roof, while painting in a dangerous position which her employer placed her in. This Worker’s Compensation settlement was obtained within 12 months of the accident, during Covid-19 times, and against the vigorous, but misguided opposition of her employer, who initially refused to sign the lump-sum settlement papers and provide his consent. Now, the firm pursues the third-party action against the general contractor in 2021.

3. In 2021, Jantzen & Associates obtained a $200,000 motor vehicle accident, bodily injury settlement for a young mother of 3 children, who suffered a back injury as a passenger in an intersection motor vehicle accident and eventually required back fusion surgery. The joint tortfeasor settlement was obtained within 9 months and represented the entire policy limits from both carriers. It was effectuated during Covid-19 times, when the firm was still working at full speed with proper precautions and safeguards.

E. Small business Litigation
